Spousal Support Modifications in New Jersey

Changing spousal support or alimony arrangements in the years following divorce can be a contentious topic. There are times, however, when modifying spousal support is warranted. Modification and Termination of Spousal Support/Alimony

On September 10, 2014, New Jersey laws relating to spousal support changed in many ways. While many of these changes to the law only apply to divorce cases going forward, in some cases it will be easier for people to modify or terminate their alimony. For instance, if you have reached the age of full social security retirement age and you are actually retiring, you may be able to terminate your alimony obligations.

A permanent and substantial change in circumstances is required for modifications of post-decree orders. Spousal support modification in Somerset County is possible if one person’s financial situation changes significantly due to circumstances such as:

  • One spouse’s income increases or decreases
  • One spouse retires, loses a job, or suffers another substantial financial loss
  • One spouse’s health changes

If the person receiving support cohabitates, support may be suspended or terminated. If the person receiving support remarries, support will terminate. It may also be terminated in situations involving the payer’s long-term unemployment, disability, or retirement at full social security retirement age.
