The caliber of your legal counsel can make a major difference in the way your property is distributed. At Shimalla, Wechsler, Lepp & D’Onofrio, LLP, our attorneys are experienced in negotiating agreements that provide our clients with the assets to which they are entitled. As necessary, we work with appraisers, business valuation experts, and accountants to obtain accurate values of property such as real estate, securities, stock options, corporations, partnerships, sole proprietorships, retirement assets, valuable collections and personal property. Our lawyers will work diligently to protect your financial security in the time following your divorce.
Retirement savings and pensions can be a couple’s most valuable assets. There are legal procedural requirements for division of retirement assets that require professional legal support. Under New Jersey law, you are entitled to equitable division if your spouse’s retirement account was established and/or grew from contributions made during the course of your marriage. We understand these requirements and can help with the allocation and division of pensions and retirement plans through Qualified Domestic Relations Orders (QDROs) and Domestic Relations Orders (DROs). Even though your marriage has ended, you can still protect your rights to retirement account benefits that will be paid in the future.
When your future benefits are at stake, our attorneys will protect your rights. Contact our office for assistance in the division of a retirement accounts.
Qualified Domestic Relations Orders (QDROs)
Qualified Domestic Relations Orders are court orders that govern the division of certain retirement benefits following a divorce. These can be pensions, 401Ks, or other retirement plans. The QDRO instructs the retirement plan administrator on how benefits will be divided between the two spouses.
Domestic Relations Orders (DROs)
We also assist clients with Domestic Relations Orders (DROs) for nonqualified plans. These include retirement benefit plans for teachers, firefighters, police officers, and government employees.
